Golden Spur Casino's Terms and Conditions
Read this carefully because this is a binding contract that you are about to enter into.
By playing at the Golden Spur Casino (the "Casino"), you represent and warrant that you fully understand and agree to comply with these Terms and Conditions and that such rules. The Company reserves the right to amend these Terms and Conditions at any time without notice to you. Such amendments will be effective immediately upon being posted in this "Terms and Conditions" section of the Company's Web site. It is your responsibility to review the Terms and Conditions on a regular basis.
The player's user details contained in the Registration Form submitted to the Casino must be true and correct.
The casino is restricted to individuals of legal age of majority (the "player"). You cannot play under any circumstances if you are not at least eighteen years of age. Participation in the activities and games (the "game") of this casino are open only to residents of those jurisdictions where such participation is legal and not prohibited. We also do not authorize players originating from the following countries: Afghanistan, Belarus, Bulgaria, Denmark, Indonesia, Israel, Pakistan, Russia.
The Player fully understands the methods, rules, and procedures of Internet gambling through the application of the software.
The Player is fully aware that there exists a risk of losing money when gambling on the Internet through the application of the software.
No purchase is necessary to play. Players may enter and play Games free of charge and without betting money. Players who choose to play for money do so at their own discretion and risk. As in any gambling game, there is the risk of loss of money. By playing the Game, you acknowledge that you do not find the Game or the Casino to be offensive, objectionable, unfair, or indecent.
Employees of the Company, its licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, retailers and members of the immediate families of each are not eligible to participate in the Game.
The player shall hold the casino, its shareholders, its employees, officers, directors, licensees, distributors, affiliates, subsidiaries, advertising, promotion or other agencies, media partners and agents harmless and shall fully indemnify the same from any and all costs, expenses, liabilities and damages whatsoever that may arise as a result of the player's:
entry, use, or reuse of the casino;
use of any materials at the casino;
entry, use, or re-use of the casino server;
participation in any game at the casino;
the acceptance of any payout/prize from the casino; or
breach of any warranty given in terms of this agreement.
The Player shall not allow any other person or third party including, without limitation, any minor, to use or reuse Player's account, access and/or use any materials or information from the Web site, accept any prize, or participate in the Games. The Player is solely responsible for the security of his/her password. Should the player have any knowledge of any unauthorized usage of the player's account and /or password by someone else the player shall contact the Casino immediately and change his/her password. The Player is solely responsible for any purchases and/or losses that may occur on your account.
The Casino shall undertake to maintain your anonymity unless you agree to your identity being used for future publicity or other purposes. The Casino will not report wagering information on behalf of any member.
All rules, regulations, and payoffs contained herein are subject to change and revision by the management without prior written notice.
The Company reserves the right, in its sole discretion and without notice to you, to add new activities or games to the Casino or to discontinue any activity or game of the Casino at any time.
The Company reserves the right to pay out all winnings at a maximum rate of four thousand dollars (USD $4,000) a week. Any winnings in excess of four thousand dollars a week will be paid out at the same weekly rate until perfect payment.
Player warrants that the player's interest in the casino is personal, and not professional. Players entering the casino do so solely for their own personal entertainment and any other entrance, access, use, or re-use of the casino by the player is strictly prohibited.
By accepting any prize and/or winnings from the Company, you consent to the use of your name and/or likeness for advertising and promotional purposes without additional compensation except where prohibited by law. Further, you acknowledge and agree that you may be required to attend a public relations event at the direction and expense of the Company, without further compensation to you.
If you have any dispute with regard to any outcome in the Game, you must submit your complaint to the Company in writing within fourteen (14) days. In the event of a discrepancy between the result showing on your Casino software and the Casino's server software, the result showing on the Casino's server software shall be the official and governing result of the Game.
Notwithstanding anything in this agreement, in the event of any dispute regarding a wager or winnings, the decision of the Casino will be final and binding in all matters.
You are solely responsible for any applicable taxes on any prizes and/or winnings that you collect from the Company.
If you do not log onto your Casino account for a period of 180 days, any balance in your account will be forfeited to the Company. Any account with a balance in their real account for over 30 days without having completed a deposit will be forfeited to the Company.
The Company reserves the right to cancel your account for any reason whatsoever at any time without notice to you. Any balance in your account at the time of such cancellation will be credited to your credit card and/or sent to you by check. However, the Company reserves the right, in its unfettered discretion, to void any winnings and confiscate any balance in your Casino account in any of the following circumstances:
If you have more than one active account for the Casino;
If the name on your Casino account does not match the name on the credit card(s) used to make purchases on your Casino account;
If you participate in a Casino promotion and cash-in before fulfilling the requirements of that particular promotion;
If you provide incorrect or misleading registration information;
If you are not of legal age;
If you reside in a jurisdiction where participation in the Game is prohibited by law;
If you have allowed or permitted (intentionally or unintentionally) someone else to play on your Casino account;
If you have not played at the Casino on an individual basis for personal entertainment only (that is, you have played in a professional sense or in concert with other player(s) as part of a club, group, etc.);
If you have any "charged back" on any of the purchases made in your Casino account using a credit card or if one of your eCheck/Firepay transactions is returned to us due to insufficient funds;
If you are found cheating or if it is determined by the Company that you have employed or made use of a system (including machines, computers, software or other automated systems) designed specifically to defeat the Casino; OR
If the Company should become aware that you have played at any other on-line casino under any of the circumstances set out at i) to x) above.
The Company shall not be liable for computer malfunctions nor attempts by Player to participate in the Game by methods, means or ways not intended by the Company.
Prior to releasing any winnings to you, the Company reserves the right to conduct a security review and to require you to provide such identification or other information or documentation as the Company, in its unfettered discretion, deems necessary. If you fail to comply with any security request, the Company reserves the right to void any winnings in your account.
The player, by providing their postal address, agrees to accept hardcopy correspondence from the casino at such address, from time to time, and acknowledges that such correspondence may carry conspicuous branding identifying the same with the casino. If the player does not wish to receive hardcopy correspondence to their postal address, they may unsubscribe from such communication by sending an email with "UNSUBSCRIBE FROM MAILING" in the subject header with their address in the body of the email.
The player, by providing their email address, agrees to receive email correspondence from the casino at such address, from time to time. If the player does not wish to receive email correspondence to their email address, they may unsubscribe.
Any and all materials submitted for prize claims become the property of the Company and will not be returned. The Company is not responsible for lost, late, illegible, incomplete, damaged, mutilated, misdirected, or postage due mail, requests, prize claims or entries.
In the event of the Player applying for a real money account at our casino, the Player in so doing authorizes us and / or our designated agent(s) to investigate his / her creditworthiness in connection with the aforementioned application and / or any subsequent purchases that the player might make at the casino.
The Company reserves the right to cancel Player's account for any reason and issue any verified balance in Player's account at the time of such cancellation.
The Casino will not be liable, and not liable for any damages in the following scenarios:
in the event of force majeure.
The failure of the Casino's central computer system or any part thereof.
For delays, losses, errors, or omissions resulting from failure of any telecommunications or any other data transmission system.
For any loss as a result of any act of God.
For an outbreak of hostilities, riot, civil disturbance, acts of terrorism.
For the acts of Government or authority (including refusal or revocation of any license or consent).
for fire, explosion, flood, theft, malicious damage, strike, lockout, or industrial action of any kind.
which may be caused to the player by the interception or misuse of any information transmitted over the Internet.
Notwithstanding any implied or express terms of this Agreement, the Player agrees that in the event that the Casino's computer hardware or software does not properly implement the rules of a casino game or does not properly implement the random number generator, or does not make proper account for the play that has occurred, the Casino shall only be liable for the Players initial deposit. For greater clarity, the Player shall forfeit any winnings made as a result of computer or software error.
Each clause contained in these terms and conditions shall be separate and severable from each of the others. If any clause is found to be void, invalid, or unenforceable for any reason, the remaining rules shall remain of full force and effect.
Casino is a foreign company and does not report any information relating to members' accounts, winnings or losses to any government agencies. It is, therefore, your own responsibility to report any winnings to your respective authorities if this is applicable in your country.
All bets are considered to be placed and received in Kahnawake Mohawk Territory under the authority of the license issued by the Kahnawake Gaming Commission. Kahnawake is the place of jurisdiction and performance/fulfilment
It is the sole responsibility of the Casino Member to ensure that he or she is fully compliant with all laws relating to online activity and/or gambling in the jurisdiction of the Member's lawful residence. Casino, its agents and its affiliates shall in no way accept liability in situations where a Member is in breach of any state, national or international laws.
